Welcome to FurShield™ (“FurShield,” “we,” “us,” or “our”). FurShield™ operates the website getfurshield.com and related content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced herein, describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy https://getfurshield.com/policies/privacy-policy. If you do not agree, do not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your state, province, or country of residence, or that you are the parent/guardian providing consent for your minor dependents to use the Services on devices you own or manage.
To use the Services (including browsing or purchasing), you may be asked to provide information such as email, billing, payment, and shipping details. You represent and warrant that such information is current, accurate, and complete and that you have the rights necessary to provide it.
You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – OUR PRODUCTS

We strive to display products accurately; however, colors and appearance may vary due to device settings and screen differences. We do not warrant that any products or services will meet your expectations or precisely match on-screen depictions.
Product descriptions, pricing, and availability are subject to change at any time without notice. We may discontinue any product or limit quantities to any person, region, or jurisdiction at our sole discretion.

SECTION 3 – ORDERS

By placing an order, you make an offer to purchase. Fur Shield may accept or decline any order at our discretion; your order is accepted only when we send a confirmation. We must receive and process payment before acceptance. Please review your order carefully; cancellation requests may not be accommodated after acceptance. If we decline, change, or cancel an order, we will attempt to notify you via the email, billing address, and/or phone number provided.
Your purchases are subject to our Refund Policy $https://getfurshield.com/policies/refund-policy$. You represent that purchases are for personal/household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time of order and set out in your order confirmation email. Unless stated otherwise, posted prices exclude taxes, shipping, handling, customs, and import charges.
Prices on our website may differ from those in physical stores or third-party marketplaces. Promotions may be governed by separate terms; if there is a conflict, the promotion terms control.
You agree to provide current, complete, and accurate purchase and account information and promptly update payment details as needed. You represent and warrant that (i) your payment information is true and complete, (ii) you are authorized to use it, (iii) charges will be honored by your payment provider, and (iv) you will pay all amounts due, including applicable taxes and shipping/handling.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you when we transfer products to the carrier.

The Services and all related content (including trademarks, brands, text, images, graphics, reviews, video, audio, and their arrangement) are owned by FurShield™, our affiliates, or licensors, and protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. Except as permitted by law, you may not reproduce, distribute, modify, create derivative works of, publicly display/perform, republish, download, store, or transmit materials from the Services without our prior written consent.
FurShield™ names, logos, and product/service names are trademarks of FurShield™ or its affiliates/licensors. You must not use such marks without prior written permission. Shopify’s names and marks are trademarks of Shopify. All other marks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools from third parties that we do not control or monitor. You acknowledge that we provide access to such tools “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms. Future new features/resources are deemed part of the Services and subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain third-party materials or links. We are not responsible for examining or evaluating such content and are not liable for any harm or damages related to your use of third-party materials, websites, products, or services. Review third-party policies carefully before engaging in any transaction.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

FurShield™ is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with FurShield™. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and FurShield™, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with FurShield™.

SECTION 10 – PRIVACY POLICY

Because our store is hosted by Shopify, certain personal information may also be processed under Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read these policies.
Information you submit will be transmitted to Shopify and certain service providers (which may be located in other countries) to operate and improve the Services. Information on the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct errors and update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit your order).

Sections intended to survive (including Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law) will survive termination.

Except as expressly stated by FurShield™, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, durability, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain disclaimers; in such cases, the foregoing will apply to the maximum extent permitted by law.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event will FurShield™ or our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors (or Shopify and its affiliates) be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any lost profits, revenues, savings, data, replacement costs, or similar damages, arising from or related to your use of the Services or products, whether based in contract, tort (including negligence), strict liability, or otherwise—even if advised of the possibility of such damages. Our aggregate liability to you for all claims will not exceed the amounts you paid to us for the product(s) at issue in the three (3) months preceding the claim, or USD $100, whichever is greater.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FurShield™, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (1) your breach of these Terms or incorporated policies; (2) your violation of any law or third-party right; or (3) your use of the Services. We will notify you of any indemnifiable claim; our failure to promptly notify will not relieve your obligations unless materially prejudicial. We may control the defense/settlement at your expense (choice of counsel), and will not agree to non-monetary obligations for you without your consent (not unreasonably withheld).

SECTION 18 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision will be enforced to the maximum extent permitted, and the unenforceable portion will be deemed severed without affecting the validity of the remaining provisions.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any provision is not a waiver. These Terms and any policies posted on the Site constitute the entire agreement between you and FurShield™ and supersede all prior or contemporaneous agreements and communications. Ambiguities will not be construed against the drafting party.

SECTION 20 – ASSIGNMENT

You may not assign or transfer these Terms or any rights/obligations without our prior written consent; any attempted assignment is void. We may assign or transfer these Terms without notice or consent.

SECTION 21 – GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services will be governed by and construed in accordance with the laws of the state of New Mexico, without regard to conflicts of law principles. You and FurShield™ consent to the exclusive jurisdiction and venue of the courts located in Santa Fe, NM, United States.

SECTION 23 – CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms at any time on this page. We may update these Terms by posting changes on the Site. We will provide notice of any material changes as required by law. Changes are effective as of the date specified in the notice or, if none, upon posting. Your continued use of the Services after changes become effective constitutes acceptance.
